Terms of Service
1. Acceptance
By installing or using Kite Pickup Delivery Date ("the App") you agree to these terms. If you do not agree, do not install it. You need an active Shopify store and the authority to install apps on it, you must be 18 or older, and you are responsible for your staff's use of the App. The App is sold to businesses.
These terms are between you and Sidharth Sharma, sole proprietor, trading as KiteLane, at Hyderabad, Telangana, India. Our Privacy Policy and our Data Processing Agreement form part of them; the Data Processing Agreement applies automatically on install and wins on anything to do with data protection. Shopify is not a party to these terms and is not responsible for the App.
2. The service
The App adds a date and time slot picker to your cart page for local delivery, store pickup and shipping. You configure availability, your shopper picks a slot, and the selection is written to the order and appears in your Shopify admin. It installs as a theme app block and does not edit your theme files.
Features are gated by plan, and one is gated twice. Checkout customisation needs both the Advanced plan from us and Shopify Plus on your side. We can lift the first by upgrade. Neither of us can lift the second. What your plan includes is what our App Store listing says for that plan.
3. Plans and order limits
Prices are USD, billed every 30 days.

An order counts when the order is created, not when a slot is picked and not when you are paid. Cancelled and refunded orders still count. The window is the calendar month. The Free plan is capped at 30 orders a month. Every paid plan is uncapped. Unlimited locations are included from Grow upward, with no location limit set by us. The Free plan does not include multi-location scheduling.
4. Reaching your limit
The date picker stops appearing on your cart and checkout pages. Orders already placed keep their date and time and stay visible in the App and your Shopify admin. You will see an upgrade prompt in the App. There are no usage-based or overage charges.
5. Billing, trials and refunds
All billing runs through Shopify. You approve the charge in your Shopify admin and we never see or store your card details. Each paid plan carries a 14-day free trial, after which the recurring charge starts automatically unless you have uninstalled or moved to Free. Your plan renews every 30 days. You can change plan at any time and Shopify prorates it.
We may change prices on 30 days notice, and you may downgrade or uninstall in that period. Charges already made are not refunded, with one exception: if you object to a new sub-processor under our Data Processing Agreement and we cannot resolve it, you may uninstall and we refund any charge covering a period after that.
6. Your responsibilities
You set the delivery days, cut-off times, prep time, blackout dates, zip code rules and locations. We supply the tool; you decide what it promises your shoppers and you have to fulfil it. The App schedules a slot, it does not deliver an order.
You are the data controller for your shoppers' personal data and we are your processor. So maintain your own privacy notice, have a lawful basis for anything you collect through the widget including any custom field you ask us to add, and do not instruct us to do anything unlawful with personal data. We will help you answer a shopper's access or deletion request.
7. Third-party integrations
Google Calendar is optional and off until you connect it. You authorise the App against your own Google account and choose which calendar receives events. We ask for the narrowest scopes the feature needs, which is reading your calendar list so you can pick one and adding events to it. Your OAuth tokens are held encrypted and revoked with Google when you disconnect or uninstall. Keeping your Google account secure is your side of it.
Events we create sit in your Google account and are your data, governed from then on by your agreement with Google. Google is not a party to these terms, we give no commitment on its availability, and an outage or API change there can stop the sync working. The App keeps scheduling orders either way. Our use of information received from Google APIs follows the Google API Services User Data Policy, including its Limited Use requirements, as set out in our Privacy Policy.
8. Acceptable use
Do not resell, sublicense, white-label or share the App outside your store, reverse engineer it, work around its plan limits, use it to process data unlawfully or send unsolicited marketing, upload malicious code, or breach Shopify's terms. Abuse or threats directed at our staff end your account immediately.
9. Intellectual property
We own the App. Installing it gives you a limited, non-exclusive, non-transferable right to use it on your store while your account is active.
You own your data. We review aggregate order counts per store to support you and improve the product, and we do not disclose that to commercial partners or investors. Ask us before you uninstall and we will send you the data we hold.
10. Support, availability and warranties
Support channels are those on our App Store listing: email and chat on Free, 24x7 on Grow, 24x7 priority on Advanced, dedicated 24x7 plus a 1:1 onboarding call on Plus. "24x7" is when you can reach us, not how fast we reply. We give no uptime commitment, and the App depends on Shopify, so an outage or API change there can stop parts of it working.
The App is provided as is and as available. To the fullest extent the law allows we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
Nothing here limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by negligence. Subject to that, we are not liable for indirect, incidental, special or consequential loss, and our total aggregate liability for all claims together is limited to the greater of USD 100 and the fees you paid us in the twelve months before the earliest event giving rise to any of them.
12. Termination
You can leave at any time by uninstalling, which cancels the recurring charge and ends this agreement. We can end it for breach, non-payment, or if we withdraw the service, giving 30 days notice where we are withdrawing it and terminating immediately for serious breach or abuse of our staff.
Shopify sends a shop deletion request 48 hours after you uninstall and we delete your store's data. Ask for a copy before you uninstall. Sections 9, 10, 11 and 14, and the deletion obligations above, survive termination.
13. Changes to terms
We may modify these terms. For a material change we give 30 days notice by email or in the App and update the date at the foot of this page. Continuing to use the App after that means you accept it. The same 30 days applies to the Privacy Policy and the Data Processing Agreement.
14. Law and disputes
These terms are governed by the laws of India, and the courts at Hyderabad, Telangana have exclusive jurisdiction. Either of us may still ask any competent court for an injunction to protect intellectual property or confidential information.
Assignment needs our written consent. If any part is unenforceable the rest stays in force. Neither of us is liable for a failure outside our reasonable control.
